Terms of Service

1. Purpose
These Terms of Service (the “Terms”) govern access to and use of the PortChief platform (the “Service”), published by DMS LOGISTICS. PortChief is a B2B marketplace connecting transport professionals for the exchange (“swap”) of containers available at ports. By creating an account, the user accepts these Terms without reservation.
2. Definitions
- User: any professional holding an account on the Service.
- Listing: a container offer or request published by a User.
- Swap: the connection of Users with a view to exchanging or reusing a container between Users.
3. Registration and account
The Service is reserved for professionals. The User warrants the accuracy of the information provided upon registration and undertakes to keep their login credentials confidential. The User is solely responsible for any activity carried out from their account.
4. Description of the Service
PortChief provides a matchmaking tool. PortChief is not a party to the transactions concluded between Users: it does not buy, sell or lease any container. Negotiating, contracting and performing exchanges are the sole responsibility of the Users concerned.
5. User obligations
- Publish accurate, lawful and non-misleading Listings.
- Not impersonate any third party or another organisation.
- Comply with the regulations applicable to container transport and handling.
- Not misuse the Service for abusive canvassing, spam or fraud.
6. Listing content
The User remains responsible for the content they publish and grants PortChief a non-exclusive licence to display that content within the Service. PortChief reserves the right to moderate, suspend or remove any Listing that breaches these Terms.
7. Liability
The Service is provided “as is”. PortChief does not guarantee the continuous availability of the Service or the successful completion of exchanges between Users. To the extent permitted by law, PortChief cannot be held liable for disputes arising between Users.
8. Personal data
The processing of personal data is described in our Privacy Policy and our Cookie Policy.
9. Intellectual property
PortChief’s trademark, logo, interface and software components are protected. Any unauthorised reproduction is prohibited.
10. Termination
The User may close their account at any time. PortChief may suspend or terminate an account in the event of a breach of these Terms.
11. Changes to the Terms
PortChief reserves the right to amend these Terms at any time to reflect changes to the Service or to applicable regulations. The applicable version is the one in force on the date the Service is used; the date of the latest update appears at the top of this document. Users are invited to review it regularly.
12. Governing law
These Terms are governed by French law. In the event of a dispute, and failing amicable resolution, jurisdiction is granted to the competent courts of the place where the publisher has its registered office.
